Welcome to the MindfulSpend mobile application ("App"), which is owned and operated by TravelArrow LLC "we", "us", or "our"). The terms "MindfulSpend" or "MindfulSpend" or "we" or "us" or "our" in these Terms of Service means TravelArrow LLC. By purchasing a MindfulSpend subscription and/or downloading, installing, accessing, or using the MindfulSpend mobile application, you agree to be bound by this End User License Agreement ("EULA") and Terms of Service ("Terms"). If you do not agree to these Terms, you must not download, install, access, or use the App. This agreement is between you and MindfulSpend.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use in accordance with these Terms and the App Store's terms of service.

2. App Description and Services

MindfulSpend is an iOS application that helps users shop less and save more. We help you stay in control of your spending and make informed decisions about your purchases.

4. User Obligations and Conduct

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must be at least 18 years old or have parental consent to use the App.

4.2 Prohibited Activities

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's operation or servers
• Attempt to gain unauthorized access to any part of the App

• Violate any applicable laws or regulations while using the App

5. Rights and Limitations

5.1 Intellectual Property Rights

The App and all content, features, and functionality are owned by MindfulSpend and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.

5.2 Service Availability

We strive to provide continuous service but do not guarantee that the App will be available at all times. We may suspend or discontinue the App or any features at any time without notice.

5.3 Data Accuracy

While we strive to provide necessary information, we do not guarantee the accuracy, completeness, or timeliness of any data provided through the App. All information, including pricing and availability, is subject to change without notice. We are not responsible for any errors, omissions, or inaccuracies in the information provided.

The App may integrate with or provide links to third-party services and websites. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with such third parties are solely between you and the third party.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MindfulSpend AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY DAMAGES RESULTING FROM YOUR USE OF THE APP.

8. Indemnification

You agree to indemnify and hold harmless MindfulSpend and its affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will cease immediately, and you must delete the App from your device.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
